The West Mission Valley LRT (trolley) was built between 1995-1997. Prior to construction a flood plain study was supposed to have been submitted to FEMA for their approval (Code of Federal Regulations 60.3(d)(3). West of HY 163, the study was submitted about 1 year after construction began. It was finally approved in 2001. East of HY 163, no such study has ever been submitted to FEMA--thus the 12 violation of the aforementioned FEMA codes. The EIR for the LRT promised that no rises in flood levels would occur from its construction. City engineer Walter Gefrom stated several years ago that the LRT did cause flood rises of about 6 inches adjacent to the 24 Hour Fitness Center at Ward Road. No flood control has been done to offset these illegal rises.

In 2007, the Planning Commission approved the Stebbins residence in Ocean Beach with a 7 foot under the flood plain plan. This was so the landowner, David Stebbins could build a larger house on a highly constrained 2500 square foot lot in the Ocean Beach floodplain (5166 W. Point Loma Avenue). This would have set a City-wide precedent to build parking garages below residences. Thanks to Council member Faulconer's leadership, City Council did not approve this variance at the November 13, 2007 hearing. Rather, they directed City staff to consider a carport option which would not be under the flood plain. The residence is being built with the carport (not underground) option.

The City Attorney wrote an excellent Memorandum regarding FEMA flood plain codes and how the City, as a member of the National Flood Insurance Program, must enforce those codes.
