Meeting Minutes



August 11, 2004


1. Call To Order.

The Regular Meeting of August 11, 2004 was called to order at 7:08 p.m.

1A. Roll Call.

Present were Perry Savoie, Malcolm Taggart, Helen Smith, Pat Shaw and Mike Larsen.
Approximately 9 observers.

2. Adoption Of Agenda.

Motion # 1.
Motion THAT the agenda be adopted as posted.
Moved by Pat Shaw, Seconded by Mike Larsen.
Vote: 5 in favour. 
Motion # 1 Carried.

3. Adoption Of Previous Meeting Minutes.


Minutes of the June 9, 2004 meeting were read.

Motion # 2.
Motion THAT the minutes be accepted with the following amendment, that the sentence reading "interveners" be changed to read "one intervener".
Moved by Perry Savoie, Seconded by Mike Larsen.
Vote: 5 in favour. 
Motion # 2 Carried.

4. Guest Speakers from the Department of Highways to discuss priorities for side-road improvements.


Catherine Harwood & Mike McArthur were present to speak with Council, and acknowledged Council's previous letter of support for work to be done on the north Old Constabulary Road. YTG was aware of the need for a serviceable road to accommodate emergency services, and highway's own snowploughs. The proposed work on Bayview Road in South McClintock and the McClintock Place Road were projects to be followed up on in the next year.
Feedback would be required from Old Constabulary residents via letters that would be going out after this meeting. If support for the project were positive, some work could be started before freeze up.  One option would be to do some of the work this fall and the rest in the spring.
It was agreed the route of the new road could be a contentious issue.  Lot owners that have received extensions no longer align with lots that haven't, creating a disparity in access for each lot to the new road.
It was stressed to YTG that a public meeting, in addition to the letters being mailed out, would be needed to help arrive at a consensus for the residents of the area, and they were asked to include a map with the letters, to assist residents with their understanding of this project.

5. Discussion of LARC application for Pettifor, Lot 32, Army Beach. Improvements to existing boat dock.

After discussion Council agreed that there was no real concerns with this application, which was in line with other similar applications for docks in the Army Beach area.

Motion # 3.
Motion THAT Chair Taggart reply by email to the LARC stating that Council has no objections based on previous similar applications in the Army Beach area.
Moved by Perry Savoie, Seconded by Helen Smith.
Vote: 5 in favour.  
Motion # 3 Carried.

6.  Report From the Chair & Correspondence.

Correspondence:

Correspondence was sent as per motions from last month's meeting.
Received:
- a notification of the new Yukon Environmental and Socio-Economic Assessment Board
- a mailer from Workers Compensation
- notice from Yukon energy concerning high water on the lake, which was distributed via mail to all property owners.
- the LARC agenda for August 12 & 13.
- a copy of the annual water analysis for the Firehall.
- a copy of the LARC minutes from the application 2004-0116 Stubenberg, Johnston Road, stating the need for a reply from Council.

Motion # 4.
Motion THAT Chair Taggart reply to the LARC decision stating that it met Council's concerns over this application, specifically the request to close the lake access at the end of Johnson Road, and the issue of the power line behind the property. Council therefore has no objection to the decision as outlined in the LARC decision.
Moved by Mike Larsen, Seconded by Pat Shaw.
Vote: 5 in favour.  
Motion # 4 Carried.


A letter was received from the Marsh Lake Fire Rescue Society concerning the overgrowth of brush along the Doehle Drive, and interference with visibility for the emergency vehicles driving the narrow road.

Motion # 5.
Motion THAT a letter be written to Don Hobbs, Director of Transportation Maintenance Branch requesting brush clearing along the right of way for Doehle drive and the intersections in Marsh Lake with the Alaska Highway.  It was requested that Highways use discretion with berry bushes in the areas being cleared.
Moved by Mike Larsen, Seconded by Helen Smith.
Vote: 5 in favour.   
Motion # 5 carried.

7. Committee Reports.


The Marsh Lake Solid Waste Management Society reported on a letter received that was written to Minister Hart from MLA Rouble, concerning the slowness of the dump project over the summer.

The Marsh Lake Community Society hosted the Mayors Highway Forum in July, to discuss the promotion of tourism along the Alaska Highway communities.  They are requesting all communities sign a MOU that states each community is interested in becoming a part of the forum.

Motion # 6.
Motion THAT Council reply to the Alaska Highway Forum with a letter stating Marsh Lake will designate a member of Council, either Mike Larsen or Perry Savoie, to attend the September 27th meeting in Dawson Creek on September 29, to sign the MOU, and that Council would like to offer its support of the forum, but is unable due to it's status a s a Advisory council to contribute financially to this endeavour.
Moved by Perry Savoie, Seconded by Mike Larsen.
Vote: 5 in favour.  
Motion #6 Carried.


The Community Society also reported that their Building Committee was moving forward, and issues with the playground had been resolved.

Association of Yukon Communities: Perry Savoie announced he would be unable to attend the AYC meeting in Tagish is September, and that Chair Taggart could attend if he was available.
The AYC would be addressing the issue of the proposed Highway sign regulations, and it was agreed that the LAC would strenuously protest the removal of yearly fees for highway signs. Council wished to clarify that the limiting of signs within a jurisdiction would remain in the new regulations.

8. Old Business.

Chair Taggart requested the Councillors complete any changes to the House Numbering maps and return to him ASAP, to be forwarded to YTG.

9. Question Period and New Business.

Chair Taggart announced that Premier Fentie is to include Marsh Lake in his Community Tour, with a public meeting October 7 at 7:30 pm at the Marsh Lake Firehall.

10. Adjournment.

The next meeting of the LAC will be on September 8, 2004.
Chair Taggart adjourned the meeting at 9:35 pm.
