Meeting Minutes



February 14, 2001


1. Call Meeting To Order
The Regular Meeting of February 14, 2001 was called to order at 7:25 PM.

1A. Roll Call
Present were Chair Malcolm Taggart, Helen Smith, and Andy Townsend.
Absent were Pam Blackburn and Patrick Rouble.

1B. Adoption Of Agenda As Amended
Tabling of LAC Budget (November 1, 2000 to March 31, 2001).

Motion #1
Motion by Helen Smith to accept amendment.
Second by Andy Townsend.
Unanimous Agreement.
1C: Adoption of previous meeting minutes
Helen Smith read minutes of last meeting, January 10, 2001.

Motion #2.
Motion: Andy Townsend motions to accept minutes as read.
Second by Malcolm Taggart.
Vote: 3 in Favor.
Motion #2 carried.

2. Report From The Chair:

Malcolm Taggart introduces Gloria Johnson as Administrative Assistant Contractor.

L.A.R.C. Applications. (Land Acquisition Review Committee)
Chair read the following points about LARC applications from a letter to LARC dated January 26, 2001.
-All public access paths left with minimum 6 meters Width.
-Must have no general opposition to applications to Lot extensions.
-No exceptions to LARC procedures, e.g. no extensions over existing trails.

Chair Taggart read letter confirming denial of application by Ian Pumphry for commercial lease.

LAC received a copy of a letter from Pam Buckway to the Marsh Lake Community Club recommending that the Marsh Lake Community Club extend its existing boundaries.

Chair Taggart received a letter in response from one he wrote to the Carcross/Tagish First Nations, written by Andy Carvill, welcoming the formation of the LAC. It was agreed to by the steering committee that the LAC will forward all meeting minutes to the CTFN to begin building a relationship.

Motion by Helen Smith to agree to the protocol of sending approved, finalized minutes to Carcross Tagish First Nations.

Chair Taggart continued with a letter and phone call from Foothills Pipeline, who want to make an appearance at the March LAC meeting to discuss future gas pipeline through the Marsh Lake area. Malcolm recommended they bring a map showing the right of way passage through the LAC territory.

Malcolm Taggart and Helen Smith reported that they met with Canada Post about the Wood Street closure. Canada Post is suggesting post boxes in various subdivisions along Marsh Lake. The naming of these post boxes, Whitehorse verses Marsh Lake as an address, will be discussed in the future. Local businesses have been asked to submit proposals for parcel service. Canada Post will host a public meeting, possibly in April.

Malcolm Taggart announced he has not made a formal application to the Lands Branch to begin a land use plan. He has found out we need money to finance this venture. He will pass on this information to those concerned who weren't present at the meeting.

2B. Tabling of Budget.

Chair reads the budget for November 1, 2000 to March 31, 2001. He points out that out of a total of $4,350.00, the new Administrative Assistant Contract fee will be paid, plus $50.00 per month will be given to LAC Councilors for travel expenses.

3. Discussion of Land Applications:

As tabled in the last meeting, discussion was opened about the land applications for Tuton, Lot 65, Army Beach and Pettifor, Lot 32, Army Beach. LAC Councilor Pam Blackburn was to talk to those residents involved. The application is for lot extensions on either side of a public access to the beach, leaving a 6 meter or 20 foot wide foot path. Currently this is a 66 foot wide boat launch access.

Residents of Army Beach who were present at the meeting expressed opposition to the application. In general they were concerned that this was the only viable boat launch left at Army Beach since the access at the public parking area has been blocked off by the large boulders put in place by Territorial Government workers. Any other public accesses are unusable due to the terrain, i.e. steep slopes, that make using them as a boat launch impractical. This access is used by local residents without beach front property and residents with beach front property who have dikes to prevent soil erosion at high water time.

Also, a suggestion was made to ask YTG to enforce keeping public access cleared of encroachments such as vehicles, fences, and out buildings. The chairman suggested a separate letter could deal with this problem.

Chair Taggart asked that all letters by Army Beach residents be sent before March 17, which was the deadline for comment given by LARC.

Motion by Helen Smith that a letter be written to LARC by the LAC, saying residents present at this meeting would like the access left open and as is.
Second by Andy Townsend.
Vote: 3 in favor.

Chair Taggart tabled the final land application on the agenda to be opened for discussion. Application by three M'Clintock Place Lot owners to rezone Lots 45, 60, and 65, M'Clintock Place, from Cottage/Residential to Commercial Tourist Lodging.

A number of residents of M'Clintock Place brought forth opposition to large enterprise in this area. Previously, many residents signed a petition in support of the application, only to find the final application much changed and expanded. A brief history of the area development after the old Lodge burned down was given. Zoning of Cottage/Residential was created for the area. Some feel the Inn On The Lake (Bed & Breakfast) already exceeds present zoning. The current applications are still in the process for rezoning the area, because no public meeting has yet been held to discuss this. The Lands Branch is required to inform all area residents and First Nations Councils, by mail, of rezoning applications.

None of the rezoning applicants were present at the meeting to discuss these applications.
Any motion for this item is tabled for the March meeting.

3B. Discussion of Police Presence in Marsh Lake.

A suggestion was brought forward that the LAC lobby the government for more Police presence in the Marsh Lake area. Marsh Lake has a larger population than many other communities in the Yukon, which have RCMP detachments. However, there are no regular patrols by the Whitehorse detachment, and they do not know the area or residents. The Community Policing Program may be an option. It was suggested to the Chair that he invite the RCMP to publicly discuss this issue. Chair Taggart said he would invite them to the April 11th meeting.
