Virginia Governor Submits the CAUS Federal Lawsuit to Virginia Court (P3N) 8-10-00 Sedona, Arizona On Aug. 8, 2000, only a day after her receipt of the petitioners' Reply Brief to the Defendant's Demurrer, Gov. Gilmore's counsel sent a 2-page letter to the clerk of the Circuit Court of the City of Alexandria, VA. P3N has obtained a copy of that letter: Dear Mr. Semonian: This office filed a demurrer and memorandum in support thereof on behalf of the Respondent, the Honorable James S. Gilmore, III, Governor of the Commonwealth of Virginia ("Governor"), in this case on June 30, 2000. Enclosed are pleadings and a final order from the United States District Court for the District of Arizona in the case of Citizens Against UFO Secrecy, Inc. v. United States, et al.(1), which the Governor asks the Court to consider in its determination of this case. In September 1999, Citizens Against UFO Secrecy, Inc.(CAUS)(2) filed a complaint in federal court in Phoenix, Arizona seeking mandamus relief against the United States, Janet Reno, Attorney General of the United States, William Cohen, Secretary of Defense of the United States, the State of Arizona, and Jane Dee Hull, Governor of Arizona. In the Complaint, CAUS requested a court order requiring certain actions by the defendants(3), as well as the court's continuing jurisdiction to enforce and modify its order. See the enclosed Complaint for Declaratory and Mandate Relief and Injunction. Like the petitioners before this Court, CAUS alleged that the individual defendants failed to respond to its letters. Id. at paragraphs 20,21,22,25 and 26. The CAUS Complaint sought relief similar to that sought by the petitioners here, particularly as to the continuing review by this Court of decisions of the Executive branch. The federal defendants filed the enclosed memorandum in support of their motion to dismiss(4), which relies on the same legal arguments asserted by the Governor in this case. On June 26, 2000, the District Court granted all motions to dismiss with prejudice and entered the enclosed order. Similarly, in this case the petitioners seek a writ of mandamus against the Governor, ordering him to exercise his discretion in a manner acceptable to them. The petitioners also seek "current and future review and remedy" by the Court, amounting to this Court's continuing oversight over the Governor's policy decisions. Thus the petitioners, like CAUS in Arizona, ask the Court to make discretionary policy and political decisions constitutionally vested in other branches of the government, and to indefinitely oversee those decisions. Therefore, the Governor renews his demurrer and asks the Court to consider the enclosed documents from Arizona. (3) Specifically, CAUS sought to compel the United States "to formulate a plan to protect the residents of Arizona against said clandestine invasion," to have the court retain "continuing jurisdiction over this case to enforce or modify the relief requested," and attorneys fees and costs. (4) The Governor and the State of Arizona moved to dismiss based upon Eleventh Amendment immunity grounds. When P3N reached Bryant at his home in Alexandria, Virginia, the UFO activist asked: "Why is Gilmore going to such lengths to have this petition quashed even as it takes on a life of its own in the Court of Public Opinion?" Bryant further stated: How convenient for him to select this inapplicable ruling of a FEDERAL court from the caus.org site while (conspicuously) ignoring the site's publication of ample, affidavit-supported evidence of the invasion. CAUS in COURT: CAUS v. Department of Defense - Appeal

On Tuesday, August 8th, I participated in a telephonic settlement assessment conference with Assistant US Attorney Richard Patrick and US Court of Appeals Mediator Lou Ross, in an attempt to resolve any of the issues which are the subject of the CAUS appeal. Mr. Ross was very sympathetic to my arguments and even broadened the parameters of the conference to include the pending CAUS FOIA request for all documents the DoD surfaced as a result of the previous CAUS lawsuit. If you remember, the DoD gratuitously added search terms such as "flying saucer," "UFO," "alien craft," and "spacecraft" and could have surfaced documents that had nothing to do with triangular aerial objects. Mr. Ross asked Mr. Patrick to expedite the release of these documents. CAUS believes these documents, as well as the administrative case files, might shed some light on the reasonableness of the DoD's search. A second telephonic conference is scheduled for August 22nd.
