Terms of Sale

Payment Terms

    1. The Buyer has to pay a down payment of $200 on the horse that they are purchasing. The payment should be received after two weeks after the agreed purchase of a horse.

    2. The down payment is refundable if the following occurs:

            1. The sold horse dies while on the premises of the Weber Paint and Quarter Horse farm. (Unless buyer did not pay for West Nile
                shots, and the horse died of West Nile)

            2. Weber Paint and Quarter Horses backs out of the sale for any reasons, which we are entitled to that right.

            3. A Doctor of Veterinary Medicine proclaims that the horse is not 100% sound.

    3. The remaining payment of the horse has to be paid in full, 4 weeks in advance of when the horse is shipped.

 

BUYERS Responsibilities

    1. Buyer must pay the remaining balance of the payment 4 weeks before shipping date. (Exception may be allowed by Seller if Seller agrees to it)

    2. Buyer must arrange for transportation of the horse. The buyer must pick up the horse their self or hire someone to pick the horse up
        before the date that the horse has to leave the farm. (Every sale has a date that the horse must leave the farm)

            1. Buyer must agree to a date for pickup of the horse with the seller.

            2. Buyer shall inform Weber Paint and Quarter Horses at least 4 weeks in advance before shipping, so Weber Paint and Quarter Horses
                can arrange to have the Coggins Testing done, and the Health Certificate issued. If informed later than 4 weeks in advanced, Weber
                Paint and Quarter Horses can not guaranteed the tests and certificates to be issued in time of shipping.

            3. Once the horse has been picked up, the horse become the Buyers sole responsibility. In other words, after the horse has been picked
                up for transportation, the horse is no longer under Weber Paint and Quarter Horses responsibility. Any death or accident that occurs
                during shipping must be taken up with the Shipper.

    3. Buyer is responsible for paying for the Coggins Testing and the Health Certificate if it is needed. Buyer also must pay for any vaccinations
        that they want done.

    4. Buyer is responsible for paying $30 for West Nile shots on foals. If they do not pay for the West Nile shots, and the horse in question dies
        of West Nile, then down payment will not be refunded.

    5. If the buyer stops communication with Weber Paint and Quarter Horses, after 4 weeks of no communication, Weber Paint and Quarter Horses will assume that the buyer backed out of the sale. Four notices will be posted to the buyers email or phone, regardless of if the email is down or phone doesn't work. It is the buyers responsibility to stay in contact with Weber Paint and Quarter Horses and inform them of any email or phone number changes. After four notices have been posted to the buyer, and still do not have any communication from the buyer, the horse will be issued for sale again, and the down payment will not be repaided.

SELLERS Responsibilities

    1. Weber Paint and Quarter Horses will get all the paper worked filled out on her side and will get it to the buyer. (Only on Registered horses)

    2. Weber Paint and Quarter Horses will get testing done on the horse in question, if buyer pays for the costs ahead of time.

        *Testing will not be done on a horse until Weber Paint and Quarter Horses are paid for it. So if the horse is to be shipped in 2 weeks, and Weber Paint and Quarter Horses has not received a check designated for testings, the testings will not be done and the horse will not be shipped at the time.

        * The check received for payment on testings can not be deducted off the remaining price of the horse. THIS IS NOT A PAYMENT FOR THE HORSE. IT IS THE PAYMENT FOR THE TESTINGS.

           

**After receiving the down payment for the horse, the buyer is required to sign a written document to these terms that are posted above. Failure to do so will result in cancellation of sale of horse.

**We make all of our clients sign that they acknowledge these terms for our own safety and the safety of our clients.

**New terms can be issued at any time on this webpage. However, if new terms have been issued, and a contract of terms has been made, the new terms will not apply unless a new contract is signed.
