Transported Semen Stallion Service Contract, Messler Paint Horses, Ropers Reflection

This STALLION BREEDING CONTRACT for the breeding season of 2004, made and entered into on this________day of ________, 20___, is by and between Sandra Messler, hereinafter designated Stallion Owner, and____________________________________________, hereinafter designated Mare Owner. Mare Owner agrees to breed the Mare___________________________________________, Reg No._______________, to the Stallion Ropers Reflection APHA# 279,261, for the Stud Fee of $650, for a live colored foal, subject to the following conditions:

  1. A booking fee of $100 of the above fee is payable with this contract and the balance of $550 will be paid upon the mare being pronounced "safe in foal" and/or when mare leaves the farm. The booking fee is non-refundable.
  2. Mare, and foal, if applicable, will be periodically vaccinated and wormed as deemed necessary by our veterinarian at Mare Owner's expense. It is recommended mares be wormed and vaccinated within 60 days of entering the farm.
  3. The State of Colorado requires a current negative Coggins test on mares coming from outside Colorado.
  4. The Mare Owner shall agree that each mare offered for breeding shall be in sound breeding condition and free from infection or disease. Any mare certified by the attending Veterinarian not to be, in his opinion, in sound breeding condition shall not be bred. A Mare Owner may substitute another mare within that breeding season.
  5. The Stallion Owner agrees to diligently try and settle the above named mare and shall have sole discretion of determining the best method of breeding such mare. If, however, the mare does not settle, the Stallion Owner shall be held harmless.
  6. Live Colored Foal Guarantee. Live foal means the foal shall stand and nurse. It is understood if the mare proves barren, aborts her foal or if the foal is stillborn, a return season will be guaranteed for the 2005 breeding season only, providing notification is given. If the foal is solid colored then a free breeding will be for the breeding season of 2005 only. Board and/or other fees such as veterinarian services will still be paid by the mare owner. If the foal appears to be solid at birth but later after shedding out has sufficient paint markings to advance to the regular registry then a $500 stud fee will be due for the guaranteed color breeding that was given in 2005. Proper notification shall be defined as follows: written certification by a licensed veterinarian within seven days that the mare has slipped or produced a non-viable foal. Mare Owner certifies that such abortion or death did not result from any act or omission of the Mare Owner subsequent to the mare's departure from Messler Paint Horses.
  7. It is further agreed that should the above named Stallion die, be sold by owner, or become unfit for service prior to settling the mare, that the Stud Fee less the Booking Fee and expenses owed will be refunded, if it has been paid in full, thereby cancelling this entire contract. If the mare dies before producing a live foal or becomes unfit to breed before being pronounced safe in foal, the Mare Owner may breed a substitute mare for the current breeding season or the following season only. No stud fees will be refunded.
  8. A breeder's certificate will be issued to Mare Owner after ALL expenses have been paid in full and upon notification of the birth of the foal.
  9. Waiver of Liability. It is understood that Messler Paint Horses, its owners, employees, veterinarians, and guests shall not be liable for any injury, escape, disability, or death of any horse on its premises. The above named Mare Owner, whose horse(s) are under the care of Messler Paint Horses will not be liable or responsible for any damage, injury, or death to the breeding farm stallions, employees, veterinarians, or other animals In the care of Messler Paint Horses, whether or not caused by his horse.
  10. This contract is non-assignable and non-transferable.
  11. This contract is entered into the State of Colorado, and will be interpreted and enforced under the laws of Colorado. If any clause in the contract is against Colorado law, then that clause shall be null and void.
  12. The following rider is attached hereto and made a part hereof. Attachment 1 dated 11/01/03.
  13. This contract represents the entire agreement between the parties. No other agreements, promises, verbal or implied, are included unless specifically stated in this written Contract. The original contract will be kept on file at Messler Paint Horses and a copy provided for Mare Owner. When Mare Owner and Stallion Owner have signed this Contract, it will then be binding on both parties, subject to the above terms and conditions.

RULES FOR STALLION SERVICE

A. The Stud Fee for Ropers Reflection is $500. The Booking Fee of $100 is due with the signed STALLION SERVICE CONTRACT.

B. A Copy of the MARE'S REGISTRATION PAPERS (both sides) must also be included with the signed Contract along with a completed REPRODUCTIVE HISTORY QUESTIONNAIRE contained in Enclosure 1.

C. Balance of Stud Fee, $400, is due when the mare leaves the ranch.

D. All other fees and expenses will be billed on a monthly basis. A finance charge of 1.5% of the unpaid balance will be charged on all balances remaining due past thirty (30) days.

E. Live Foal Guarantee: If the Mare does not produce a live foal in 2005, a rebreed will be allowed for the same mare or a substitute mare for the 2005 season only.

F. Mare (and foal, if applicable) will be periodically vaccinated and wormed as deemed necessary by our Veterinarian at Mare Owner's expense. Every effort will be made to insure that your mare (and foal) receive the best care possible.
