" WHAT A DAY IS LIKE ON DEATH WATCH FOR AN INNOCENT MAN" Michael Minerva heads at the time of Medinas death the Capitol Collateral Representative , the State agency that represents death-row inmates
FLAMES ERUPT FROM INMATE`S MASK DURING FLORIDA EXECUTION. March 25. 1997 Witnesses and prison officials said a 6-inch flame arose from the right side of Medina`s black leather face mask during the execution. flickering for several seconds and filling the room with smoke and the smell of burning flesh. He was executed despite his claims of innocence and mental illness, pleas of mercy from the daughter of the victim and a letter from the pope. Judge Soud ruled in April 1997 that problems with the chair had been fixed, and any future executions would be constitutional. He said he was convinced that Medina felt no unnecessary pain. Medina`s lawyer, Marty Mc Clain, said this after the execution: "Florida should discontinue (use of the electric chair) There is a growing trend. About eight states have stopped using the electric chair. There are only three states that use it on a regular basis. They`re in Florida, Georgia and Alabama, and I think it should be stopped." INMATE SAYS DEATH BY ELECTROCUTION IS CRUELAn inquiry was held after this gruesom incident that outraged people all over the world. As a result of this incident, hearings were held in a north Florida courtroom on behalf of Leo Jones, who was to be executed April 15 1997. defense attorney Martin McClain said:" The sole issue to be determined is whether the electric chair in its present condition is cruel and unusual punishment." Jones` attorneys are focusing on the Medina execution, during which flames shot out from behind his face mask. Witnesses testified that his body jolted for several minutes after the electricity was turned off. Jones execution was on hold until the court has resolved Leo Jones complaintthat the electric chair amounts to cruel and unusual punishment, a violation of the U.S. Constitution. Duval Circuit Judge A.C. Soud was to issuea ruling August 8. 1997.THE GOVERNOR OF FLORIDA Jones` attorneys won a continuation of the hearing from the Florida Supreme Court, which ruled that Soud did not allow themto call expert witnesses. Pedro Medina IT IS POSSIBLE HE EXPERIENCED PAIN.testified Dr. Jonathan Arden, first deputy chief medical examiner of New York City, at the hearing. Another forensic pathologist said any sign of breathing by Medina would indicate the brain was still working. Arden said there was little doubt that Medina was still alive. THE SUPREME COURTOF FLORIDA will hear oral argumentsSeptember 8. 1997.
