Benjamin Creech's Will (1802)*
In the name of God amen. I Benjamin Creech of the State of
North Carolina and County of Lenoir Being well in Body and of perfect
mind and sound memory Thanks be to God for the same Therefore caling to
mine the mortality of my body and knowing that it is appointed for all
men once to Die do this sixth day of February in the year of our Lord
one thousand Eight hundred and two make and ordain this my last will and
Testament that is to say principally and first of all I Give and
Recommend my soul unto the hands of almighty God Who first gave it and
my body I Recommend to the Earth to be Buried in decent Christian Burial
at the Discretion of my Executors Nothing Doubting But at the general
Resurrection I shall receive the same by the mighty power of God who
gave it and as touching my worldly Estate wherewith it hath pleased God
to bless me with here in this life I Give, Devise, and Dispose of the
same in manner and form as followeth to wit:
First, my wish is that all my just Debts together with my
funeral expense be Duly and Principally paid
Secondly I Lend to my True and Loveing wife Patty Creech all my
Moveable Estate (only such as I shall hereafter Except and Give to my
children) Dureing her continuing my widow. I also (words faded out, or
omitted?) one Negroe woman Edy and her children. Also I lend her fifty
acres of land out of the part that I have given Henry Creech a deed for
Including my house I now live in twenty-five acres of which land is to
be lent and the Remainder is to be hers (a few faded and illegible
words)
Thirdly I give and bequeath to my loving Daughter Sally Kennedy
one Mare two Cows and Earlins one feather Bed of furniture which
property she has Ready. I also Give her one Negroe Boy Named Ned at my
Wife's Death to her and her heirs Lawfully begotten by her Body
forever
Fourthly I Give and Bequeath to my loving son Edward Creech one
Mare Bridle and saddle The hogs that he has in his possession one
feather Bed of furniture two head of Cattle One Ewe and Lam to him and
his heirs forever
Fifthly I Give and Bequeath to my Loveing son Henry Creech One
horse at the Value of Thirty-six pounds one feather Bed of furniture two
head of Cattle two Sows and hogs one Ewe and Lamb one Saddle and Bridle
to him and his heirs forever
Sixthly I Give and Bequeath to my Loveing Daughter Patty Creech
One Negroe Boy Named Jim One horse of the Value of Thirty-six pounds and
two Cows and Earlings one feather Bed and furniture One Ewe and Lamb to
her and the heirs Lawfully Begotten by her Body
Seventhly I Give and Bequeath to my Grandson William Creech at
his Comeing of Lawful age fifteen pound in money to him and his heirs
forever
Eightly I leave my Negroe woman Edy and her Increas that she
may have hereafter to be Equally divided Between my two sons Edward and
Henry Creech after my wife's Death to them and their heirs forever
Ninthly I leave all the property that I have Lent my wife to be
Divided into Equal parts at her Death or marriage and my two sons Edward
and Henry Creech to have one-half between them and my two Daughters
Sally and Patty to have the other two to them and their heirs forever
Tenthly I constitute and appoint my two sons Edward Creech and
Henry Creech my sole Executors of this my last will and Testament and I
do hereby utterly disallow and Decree nul and Revoke all other former
wills, Bequeaths, or Legatees Ratifying and Confirming this and no other
to be and remain my Last Will and Testament In Witness whereof I the
said Benjamin Creech have hereunto set my hand and seal the Day and Date
above Written

us who in his presence and in the presence of Each other have Set our
Names

Benjamin Creech Jr. b. 1753 in old Johnston County, N.C.; later became Dobbs and Lenoir County,
N.C. He died between 1800 and 1810 in the county of Lenoir. He married ca 1771 Louisa Mozingo, the
dau. of Boothe and Celia Mozingo of Lenoir County. Benjamin Creech Jr. served in the American
Revolution from Dobbs County, N.C. He was drafted into Captain Kennedy's Company July 26, 1777
with his brothers John and Ezekiel Creech. He was shown on the 1769 and 1780 tax list from Dobbs
County; also on the 1790 and 1820 federal census of Dobbs and Lenoir Counties. One strange thing
about the descendants of Benjamin Creech, Jr. was that nearly all of them left Lenoir County for other
parts of the state and country. By 1850 very few were left in the county of Lenoir. Benjamin Creech Jr.
was paid for war services in 1776 from N.C. Benjamin Creech Jr. is buried in the old Creech Cemetery in
Greene County on Rainbow Run with his father, wife and two brothers. Had issue;
1. William Creech b. ca 1772 married and had at least two sons and two daughters. He was shown on the 1820 Lenoir County Census with these children but in a deed later from Delia Mozingo to William
Creech's children, so he must have died before 1830 census. William Creech received a deed from his
father Benjamin Creech Jr. and at another time Benjamin Creech was proved as guardian for William
Creech. He m. Sally Herring, dau. of Benjamin Herring of Duplin Co. N.C. (a deed bears this out)
2. Edward Creech b. ca 1774 died in Lenoir County, N.C. m. Mary Herring, dau. of Benjamin Herring of
Duplin Co.; two sons and two daughters. Edward received land from his father in two deeds (shown
later). It seems that Edwards' issue left Lenoir County for parts unknown (Benjamin Herring deeded land
to his dau. in Duplin Co. )
3. Henry Creech b. ca 1776 in old Dobbs County, N.C. and died in Lenoir County, N.C. He married but
wife is unknown, but died without issue. He sold land to Joshua Sugg of Lenoir County.
4. Benjamin Creech, III b. ca 1783 in old Dobbs County(now Lenoir). He was also shown on the 1820
census of Lenoir County, N.C. Benjamin Creech 3rd married Feb 13, 1808 Sally Creech, a first cousm.
b. ca 1778, the dau. of Joshua Creech Sr. and Sally Stanford. Issue;

acres in 1835. He made his home near Four Oaks, Johnston County, N.C. Had issue;
