DESTRUCTION OF EVIDENCE

During McWilliams' second level of appeal's, he requested that the prosecution turn over all evidence in order for the evidence to be retested. The prosecutor told the Court that all evidence had been destroyed by Paul Smith, the court reporter that worked during McWilliams' trial. Mr. Smith transcribed the trial testimony and he was the person that was given custody of the trial exhibits and evidence.

McWilliams sought all of the scientific evidence from his case in order to prove his innocence, Mr. Smith was contacted and wrote back stating that he had looked everywhere for anything related to McWilliams' case, but could not do so because he only kept the documents under the "one year retention plan".

Mr. Smith wrote that, when Judge Lake was elected in 1992, he wanted his new reporter to be able to use the more secure lockup at the back of his courtroom, so Judge Lake requested Mr. Smith to move his records out.

Mr. Smith supposedly took all of the evidence in McWilliams' case (and numerous other cases) out to a local dump and threw it all away! The prosecutor told the Court that all evidence had been destroyed by Ms. Smith and that no evidence existed for retesting.

A closer examination by McWilliams of the files, show that Mr. Smith did not have all of the evidence. Some of the evidence remained with the Department of Forensic Sciences well after Mr. Smith's destruction of vital evidence that would have proven McWilliams' innocence.

Evidence remained at two different Department of Forensic Science labs, until Tuscaloosa police investigator's mysteriously began removing the physical evidence from the labs well after Mr. Smith's actions!

On November 30, 1993 (one year after Mr. Smith allegedly destroyed all evidence), Officer Bush of the Tuscaloosa Homicide Unit, went to the Department of Forensic Sciences lab and left with the following evidence:
  1. The Victim's Boots;

  2. Three (3) Bullet Fragments;

  3. Two (2) Samples Of Blood;

  4. One (1) White Blouse;
    (Confiscated from McWilliams)
  1. One (1) White T-shirt;
    (Confiscated from McWilliams)
  2. One (1) Toy Gun;
    (Confiscated from McWilliams)
  3. Two (2) Pair Green Army Fatigues; (Confiscated from McWilliams)
  4. Clothing Evidence Confiscated From Suspect Jerry Porter.
[Note: McWilliams' clothing that was confiscated from the vehicle he was driving at the time of his arrest, (that the prosecutor told the jury McWilliams destroyed) was still at a crime lab eight years later, as well as clothing seized from Jerry Porter!]

On May 11, 1995 (Three years after Mr. Smith allegedly destroyed all evidence), Investigator Steel of the Tuscaloosa Homicide Unit, went to the Montgomery lab of the Department of Forensic Sciences and left with the following evidence:

  1. Blood
  2. Fingerprints Removed From The Interior Of The Victim's Car.

[Note: The prosecutor lied to the Court when he stated that all evidence had been destroyed by Mr. Smith in 1992! Why were police investigator's taking the very evidence that would conclusively resolved the issue of McWilliams' innocence! There is no record that these officers were instructed to retrieve this evidence. There was no purpose for this retrieval of this evidence other than to ensure its loss or destruction before McWilliams could have it tested and prove his innocence!

The prosecutor will not:

  1. Release the files of Jerry Porter;
  2. Release the results (if any exist) of forensic testing on Jerry Porter's clothing;
  3. Release the unique coin found during the search of Jerry Porter's girlfriend's bedroom, that may or may not match unique coins stolen from Ms. Reynolds, the victim; during her murder;
  4. Test the known fingerprints of Jerry Porter against the finger-prints found in the store and interior of Ms. Reynolds car that was last driven by her murderer.
[Note: Even the fingernail scrapings taken from Ms. Reynolds hands, that suggest she was in a struggle with her murderer; have been allegedly destroyed! Initial testing concluded that blood and fiber were present; suggesting that her attacker would have fingernail scratch marks on their body. Which Jerry Porter did have and McWilliams did not have.]

The Gun and Bullets have also mysteriously disappeared and no one knows their whereabouts!

The semen recovered from Ms. Reynolds clothing has also allegedly been destroyed!

With all the proven lies of the prosecution, how can it be believed that the destruction of vital evidence that would have proven McWilliams' innocence; was not a deliberate act by the prosecutor and police investigator's to hide the truth! The truth being that McWilliams is NOT THE MURDERER How far will the prosecution and police go in order to execute an INNOCENT MAN!
