2000 LMOU


ITEM #1 ADDITIONAL OR LONGER WASH-UP PERIODS

A reasonable wash-up time is defined as ten minutes. (Five minutes wash-up time for lunch break and five minutes wash-up time at the end of the tour.


ITEM #2 THE ESTABLISHMENT OF A REGULAR WORK WEEK OF FIVE DAYS WITH EITHER FIXED OR ROTATING DAYS OFF.

All Regular work week schedules shall be five (5) days, with fixed days off.


ITEM #3 GUIDELINES FOR THE CURTAILMENT OR TERMINATION OF POSTAL OPERATIONS TO CONFORM TO ORDERS OF LOCAL AUTHORITIES OR AS LOCAL CONDTIONS WARRANT BECAUSE OF EMERGENCY CONDITIONS.

A. Upon notification of local authorities, management shall immediately notify the local Union official (e.g. Tour Steward or an Alternate) of the emergency conditions existing.

B. If emergency conditions occur that result in curtailment of postal operations, the parties to this Agreement will meet with the Union to discuss the impact of this emergency. Management will not conceal any information they received from other sources (e.g. bomb threats, malfunctioning heater and/or air conditioner units) that might potentially contaminate the environment in which employees perform their duties.


ITEM #4 FORMULATION OF LOCAL LEAVE PROGRAM

A. The Employer shall meet with the representatives of the Union as soon after January 1 as practicable to review local service needs and determine local procedures for Choice Vacation Periods(s).

B. The Employer shall notify the Union in writing of the time and place of this meeting and the number of participants authorized to attend this meeting.

C. The Employer shall post a notice on all bulletin boards on the second Saturday of January, inviting requests for Choice Vacation.

D. All requests must be submitted in duplicate on Form 3971.

E. A chart showing the entire prime time vacation periods will be posted in the work area.

F. Commencing on the second Saturday in January, employees, by seniority will indicate their preference for available weeks of vacation time, according to their leave earning rate. Selection must be made within three (3) days.

G. No request shall be accepted prior to the posting of the notice.,

H. All request submitted must show a Supervisor's initials and date on form 3971.

I. After review of the requests, the Employer shall confer with unsuccessful applicants, by seniority, and advise them of any time still available.

J. All requests shall be governed by office-wide seniority.

K. Approved leave will be posted on Prime Time vacation chart.

L. The following rules will apply to all Annual Leave request during the leave year (including Choice Vacation period):

   1. Forfeiture of Approved Annual Leave:

     a. Voluntary - must be done at least 12 days prior to scheduled Annual Leave. If not, employee will be required to take Annual Leave.

M. All Annual Leave requests that have been approved and verified from former offices of clerks transferring in shall be honored by our office.

N. Every possible consideration for Emergency Leave shall be given in situations of personal emergency.


ITEM #5 THE DURATION OF THE CHOICE VACATION PERIOD(S)

Choice Vacation Period: Last two weeks in May, to and including the first week in October and the week between Christmas and New Year's Day. (Changed)






ITEM #6 THE DETERMINATION OF THE BEGINNING OF AN EMPLOYEE'S VACATION PERIOD.

All request for choice Vacation weeks shall indicate Monday as the starting day.


ITEM #7 WHETHER EMPLOYEES AT THEIR OPTION MAY REQUEST TWO SELECTIONS DURING THE CHOICE VACATION PERIOD, IN UNITS OF EITHER 5 OR 10 DAYS.

A. Article 10, Section 3.D, will be the determining factor in administering this item.

B> Employees may not initially request three separate selections of five days.


ITEM #8 WHETHER JURY DUTY AND ATTENDANCE AT NATIONAL OR STATE CONVENTIONS SHALL BE CHARGED TO THE CHOICE VACATION PERIOD.

Employees called for jury duty, plus one National Convention delegate plus two State Convention delegates, plus two Trine session delegates, will not be charged to the Choice Vacation Period. (Changed)


ITEM #9 DETERMINATION OF THE MAXIMUM NUMBER OF EMPLOYEES WHO SHALL RECEIVE EACH WEEK DURING THE CHOICE VACATION PERIOD.

Maximum number of employees who shall receive leave each week during the choice Vacation Period shall not exceed 14% rounded to the next whole number. Actual Number will be determined in January and will apply to the entire leave year. (Changed)


ITEM #10 THE ISSUANCE OF OFFICIAL NOTICES TO EACH EMPLOYEE OF THE VACATION SCHEDULE APPROVED FOR SUCH EMPLOYEE.

All leave requests must be submitted in duplicate on Form 3971. The duplicate copy will be returned to the employee.l


ITEM #11 DETERMINATION OF THE DATE AND MEANS OF NOTIFYING EMPLOYEES OF THE BEGINNING OF THE NEW LEAVE YEAR.








ITEM #12 THE PROCEDURE FOR SUBMISSION OF APPLICATIONS FOR ANNUAL LEAVE DURING OTHER THAN THE CHOICE VACATION PERIOD.

A. Annual Leave requests for the following Annual Leave year shall be accepted from December 1 to December 10 of the current year. Requests submitted during this time shall be granted on a seniority basis. The 48-hour rule on approval or disapproval is waived on these requests. Written approval or disapproval will be given by the beginning of the new leave year.

B. Annual Leave request submitted after December 10 shall be granted on a "First come, first served basis" after the Annual Leave requests submitted December 1 to December 10 have been approved.

C. Except in emergencies, all leave requests must be submitted by the end of the work day on Tuesday for all days desired in the next service week.

D. Approval or disapproval shall be given withing 48 hours. If approval or disapproval is not given within 48 hours, request shall be deemed approved.

E. If disapproval is given to an Annual Leave Request, the Supervisor shall state the reason for the disapproval on the returned request to the employee. The employee will then be placed on the Annual Leave chart as an alternate.

F. Maximum number of employees who shall receive leave shall not exceed 9% rounded to the next whole number. (Changed)


ITEM #13 THE METHOD OF SELECTING EMPLOYEES TO WORK ON A HOLIDAY.

A. When a holiday falls on an employee's regularly scheduled workday, management shall comply with Article XI of the National Agreement for scheduling.

B. Method of scheduling shall be in strict compliance with Article XI, Section 6 of the National Agreement as follows:

Management will determine the number and categories of employees needed for holiday work.

  1. Casuals - even if overtime is necessary.

  2. Part-Time Flexibles - even if overtime is necessary.

  3. Full-Time and Part-time Regular volunteers - on their holiday or designated holoday by seniority.

  4. Full-time and Part-Time Regular volunteers - whose drop day falls on a holiday.

  5. Non-volunteer Full-Time and Part-Time Regulars - whose drop day falls on a holiday.

  6. Non-volunteer Full-Time and Part-Time Regulars - on their holiday or designated holdiay.

C. All Full-Time non-volunteers will be rotated by juniority.


ITEM #14 WHETHER "OVERTIME DESIRED" LISTS IN ARTICLE 8 SHALL BE BY SECTION AND/OR TOUR.

The Overtime Desired lists shall be by section, one indicating a limit of 10 hours, and one indicating a limit of 12 hours. (Changed)



ITEM #15 THE NUMBER OF LIGHT DUTY ASSIGNMENTS WITHIN EACH CRAFT OR OCCUPATIONAL GROUP TO BE RESERVED FOR TEMPORARY OR PERMANENT LIGHT DUTY ASSIGNMENT.

Present policy will remain in effect.


ITEM #16 THE METHOD TO BE USED IN RESERVING LIGHT DUTY ASSIGNMENTS SO THAT NO REGULARLY ASSIGNED MEMBER OF THE REGULAR WORK FORCE WILL BE ADVERSELY AFFECTED.

Light duty assignments will be considered supplemental to the regular work force.


ITEM #17 THE IDENTIFICATION OF ASSIGNMENTS THAT ARE TO BE CONSIDERED LIGHT DUTY WITHING EACH CRAFT IN THE OFFICE.

Present policy will remain in effect.


ITEM #18 THE IDENTIFICATION OF ASSIGNMENTS COMPRISING A SECTION, WHEN IT IS PROPOSED TO REASSIGN WITHIN AN INSTALLATION EMPLOYEES EXCESS TO THE NEEDS OF A SECTION.

Present policy will remain in effect.




ITEM #19 THE ASSIGNMENT OF EMPLOYEE PARKING SPACES.

Present policy will remain in effect.


ITEM #20 THE DETERMINATION AS TO WHETHER ANNUAL LEAVE TO ATTEND UNION ACTIVITIES REQUESTED PRIOR TO DETERMINATION OF THE CHOICE VACATION SCHEDULE IS TO BE A PART OF THE TOTAL CHOICE VACATION PLAN.

This leave is in addition to the number of employees allowed off. (Changed)


ITEM #21 OTHER ITEMS SUBJECT TO LOCAL NEGOTIATION:

A. Management shall give advance information to and shall consult with the Union prior to making any changes to work assignments that would affect the employee's duties, principle assignment area or scheme knowledge requirements.

B. Management shall give advance information to and shall consult with the Union on any permanent change in the starting time of a duty assignment.

C. Except for an emergency, management shall give at least one-hour advance notice of overtime. When no emergency exists and less than one hour notice is given for overtime, an employee shall not be required to work.

D. The Union will be notified at the same time the Employee is notified of being excessed from the West Chester Post Office.

E. When a duty assignment is posted for bid, a notice for inviting bids shall be posted and remain for seven calendar days.

F. The successful qualified bidder shall be placed in the new assignment withing twelve working days, except in the month of December, following the awarding of the assignment.

G. A change in the starting time of a duty assignment exceeding one hour shall cause the assignment to be posted for bids. The incumbent shall have the option of accepting the new reporting time.

H. The Union shall receive a copy of the notice inviting bids and a copy of the notice stating the successful bidder.

I. Should a job be occupied for more than thirty days by detail, Management will consult the Union.

J. A Union representative must be present when bids are opened.

K. The Union shall be furnished an up-to-date Seniority Roster and all future changes of seniority on a quarterly basis.

L. Employee may see his/her Official Personnel file in the presence of the Postmaster of designees if request made in writing 24 hours in advance.

M. No window clerk shall receive stock while working at the window. (Changed-Deleted)

N. Employees shall be granted time on the clock for the purpose of donating blood. (Changed-Deleted)

O. Management shall authorize the establishment of the following committees pursuant to the provision of the Postal Service Manual: (Changed-Deleted)

Good Housekeeping
Employee Welfare
Safe Driver Award
Scheme

P. Management will provide steward time according to Article 17.3 of the National Agreement.

Q. Labor/Management committee meetings will be held the second Wednesday of January, March, May, September and November.

   1. The employer shall notify the Union, in writing, as to the time and place of these meetings.

   2. These meetings do not preclude any other necessary conferences such as Christmas and Annual Leave.

   3. The Employer and Union shall be limited to three (3) participants each at Labor/Management meetings.

   4. The Employer or the Union shall notify each other, in writing, as to their participants at these meetings no later than two days prior to the meeting.

   5. Unless omission of an item is mutually agreed upon, agenda items of either party at Labor/Management meetings shall be submitted in writing to the other party no later than one week prior to these meetings.

   6. The Employer shall give disposition to Agenda Items in writing no later than two weeks following these meetings.

R. One Union official may attend Trine Sessions during non-prime time vacation periods above the limited number of employees scheduled for leave without being charged for non-prime time vacation.


ITEM #22 LOCAL IMPLEMENTATION OF THIS AGREEMENT RELATING TO SENIORITY, REASSIGNMENTS AND POSTING.

For the purpose of reassignment, the installation is a section.

The decision for curtailment or termination of Postal Operations to conform to orders of local authorities or as local conditions warrant because of emergency conditions, shall be made by the installation head. When the decision has been reached to curtail Postal Operations, the the extent possible, management will notify and seek the cooperation of local radio and television stations to inform employees.

The installation head or designee shall met with a representative of the Local APWU to review local service needs as soon after January 1st as practicable. The installation head shall then determine a final date for submission of applications for vacation period(s), as provided for in Article 10 of the National Agreement. Section 3.D.1,2,3 of the National Agreement and this LMU. Choice vacation leave is to be granted on a seniority basis.

A. Approved leave shall be posted on the Choice Period vacation chart.

B. The following rules will apply to all Annual leave requests:
